Cancellation Policy

This Cancellation Policy outlines the terms under which buyers and vendors may cancel transactions on Robotbids, a marketplace operated by DEO Ecommerce LLC, a U.S.-based company. We are committed to maintaining a fair, transparent, and legally compliant environment for commerce. This policy is designed to protect the rights of both buyers and vendors and is applicable to users based in the United States, European Union, and other supported jurisdictions.

1. Legal Framework

This Cancellation Policy is governed by:

  • U.S. Federal and State Consumer Protection Laws, including the Federal Trade Commission (FTC) Act.

  • European Union Consumer Protection Directives, including Directive 2011/83/EU on Consumer Rights, and General Data Protection Regulation (GDPR) for applicable user data handling.

  • Platform-level responsibilities under intermediary liability exemptions, as per Section 230 of the U.S. Communications Decency Act and the EU’s Digital Services Act (DSA).

Robotbids is not the seller of goods listed on the marketplace; rather, we facilitate transactions between independent vendors and buyers. Therefore, cancellation terms may vary by vendor but must meet the baseline protections established in this policy.

2. Buyer-Initiated Cancellations

Buyers may cancel an order under the following conditions:

2.1 Before Shipment

  • Cancellation requests must be submitted before the item is marked as “shipped” by the vendor.

  • Buyers can initiate cancellation via their Order History by selecting the item and clicking “Request Cancellation.”

  • The vendor will have 48 hours to approve or deny the request.

  • If the vendor approves the request, the order will be canceled and refunded in full.

  • If the vendor denies the request or has already shipped the item, the buyer must pursue a return or file a dispute, subject to the vendor’s individual return policy.

2.2 After Shipment

  • Cancellations are generally not permitted after shipment.

  • Buyers in the EU may exercise their 14-day right of withdrawal under Directive 2011/83/EU (excluding custom-made or perishable goods), provided the item is returned in its original condition.

  • U.S. buyers may be entitled to return the item under the vendor’s return terms but are not legally guaranteed a cancellation right post-shipment.

3. Vendor-Initiated Cancellations

Vendors may cancel orders for the following legitimate reasons:

  • The item is out of stock or discontinued.

  • A pricing error or listing mistake has occurred.

  • Buyer’s shipping address is incomplete, unverifiable, or undeliverable.

  • Fraudulent activity is suspected on the buyer’s account.

3.1 Restrictions on Vendor Cancellations

  • Vendors must not cancel orders solely due to delayed processing or dissatisfaction with the sale price.

  • Repeated, unjustified, or abusive cancellations may result in warnings, listing restrictions, or account suspension.

  • Vendors are required to notify the buyer via platform messaging of the reason for the cancellation.

4. Automatic Cancellations by Robotbids

Robotbids reserves the right to automatically cancel transactions under the following circumstances:

  • The vendor fails to confirm shipment within 7 business days of the order date.

  • The transaction is flagged for potential fraud or violates marketplace terms.

  • Payment is declined, reversed, or flagged as suspicious by our payment processing partners.

  • A confirmed breach of Robotbids Terms of Service or Marketplace Policies.

In such cases, Robotbids may process the refund without the vendor’s prior approval, and may apply sanctions if policy abuse is confirmed.

5. Refund Policy for Cancelled Orders

5.1 If Payment Has Not Been Processed

  • The order will be voided and no charges will be applied.

5.2 If Payment Has Been Processed

  • A full refund will be issued to the buyer’s original payment method.

  • Refunds are generally processed within 3 to 10 business days, depending on the payment provider.

Robotbids does not guarantee faster refunds for delays caused by financial institutions or third-party payment processors.

6. Marketplace Role and Limitations

Robotbids is a neutral intermediary between buyers and vendors. We do not own or control the inventory listed, nor do we dictate final decisions on cancellations once an order is placed. However:

  • We may mediate disputes between parties.

  • We may intervene if vendors or buyers violate platform rules or applicable laws.

  • In the EU, we comply with the Digital Services Act, including transparency obligations and a trusted flagger system.

  • In the U.S., we operate under the safe harbor provisions of Section 230, but reserve the right to remove content or suspend accounts that breach this policy.

7. Special Considerations by Jurisdiction

7.1 European Union Residents

  • EU buyers have the legal right to withdraw from most purchases within 14 calendar days without giving any reason.

  • Vendors must clearly state whether they honor the withdrawal period and provide a model cancellation form if operating from or selling to the EU.

  • Return shipping costs are generally borne by the buyer unless otherwise specified.

  • Certain goods are exempt from cancellation under EU law (e.g., perishable items, personalized goods, unsealed health products).

7.2 United States Residents

  • There is no federal “cooling-off” period for online purchases unless explicitly offered by the vendor.

  • State-specific consumer rights may apply, and vendors are expected to comply with the buyer’s local laws (e.g., California Consumer Protection Act).

  • All vendors must clearly display their own cancellation, return, and refund policies on product listings.

8. Policy Enforcement

Robotbids monitors all cancellation activity to prevent misuse. Repeated or patterned abuse of cancellation privileges by either party (e.g., frequent buyer remorse, vendor over-listing) may result in:

  • Temporary suspension of listing or buying privileges.

  • Permanent removal from the platform.

  • Legal action if fraud or misrepresentation is involved.

9. Contact and Dispute Resolution

If you encounter an issue that cannot be resolved through the platform’s cancellation process:

  • Please contact support@robotbids.com with the order number and relevant details.

  • For EU residents, cross-border disputes may be eligible for resolution through the European Online Dispute Resolution (ODR) Platform.

  • U.S. users may escalate claims via state attorney general offices or file small claims depending on jurisdiction.

Robotbids (DEO Ecommerce LLC) reserves the right to amend this policy at any time. Users will be notified of significant updates via email or platform announcement.
